Effective beginning 10 December 2025, the Online Safety Amendment (Social Media Minimum Age) Act 2024 ranks among the world’s strictest internet regulations, placing the responsibility to safeguard minors squarely on Big Tech and heralding a significant reckoning with the digital age.
The rationale behind this pivotal legislative shift and the compelling statistics driving change highlights the crucial link to cybersecurity, and helps clarify the complex path forward for implementation.
The Rationale: Why 16?
The rationale for the ban can be found in the preponderance of mental health and developmental crises among adolescents. While social media can offer educational and social benefits, a growing body of evidence indicates that unrestricted, algorithm-driven exposure during the most vulnerable years of adolescence poses significant risk.
The Australian Government and the eSafety Commissioner have cited evidence indicating that by age 16, adolescents are generally considered to have matured beyond the most vulnerable phases of psychological development affected by constant online exposure2.
The minimum age requirement applies to platforms primarily designed for social interaction and content sharing, including major platforms such as TikTok, Instagram, Facebook, X, YouTube, and Snapchat. Notably, the law imposes fines of up to AU$50 million on noncompliant platforms, while imposing no penalties on users or their parents.
Statistics Driving Action
The government’s decision to impose a statutory minimum age is underpinned by alarming domestic statistics concerning youth digital engagement and wellbeing:
- Mental health decline—Data from organizations such as Headspace demonstrates that the perceived negative impact of social media on young Australians' mental health is considerable3. Recent surveys indicate that a significant portion of young Australians cite social media as a primary factor in their deteriorating mental health, showing an increase from previous years4. Mental health decline is often associated with cyberbullying, exposure to harmful content, body image worries, and social comparison anxiety.
- High usage rates—Despite minimum age requirements (typically 13), nearly all young people (97%) aged 15–19 report daily social media use. Almost 2 in 5 (38%) spend 3 hours or more on these platforms each day5 While moderate use can improve social connections, heavy use is strongly associated with increased psychological distress, loneliness, and a less optimistic outlook for the future.
- Exposure to harm—Australian teens often encounter harmful content online. Data shows that many teens report being contacted by strangers or unfamiliar people (unwanted contact) or receiving inappropriate or violent content. For younger users, especially those aged 12–13, the average number of platforms they use is already relatively high (around three), putting them at risk much earlier6.
- The vicious cycle—High social media use is also associated with a decline in healthy, real-world activities. For example, users who regularly visit social media platforms are much less likely to participate in sports than moderate and low users, potentially creating a vicious cycle of digital isolation and poor wellbeing.
Taken together these statistics reveal a cyberlandscape that is not only technical, but profoundly human. This underscores the need for security professionals to design, implement, and refine controls with psychological safety and youth vulnerability in mind as core considerations.
The Cybersecurity Mandate: Data, Identity, and Risk
The ban has significant implications for cybersecurity and data privacy—issues that have become increasingly important in Australia after major national data breaches.
The main challenge is implementation. To comply, social media platforms must use robust age-verification technologies to verify each user's age. This requirement introduces several new security risk vectors:
- Identity collection—Effective age verification often requires gathering sensitive personal information. Although the Act explicitly prohibits requiring the use of government-issued IDs (Digital IDs or passports), platforms must provide reasonable alternatives, which may include facial recognition, biometric age estimation, or third-party verification. The rise of these new, highly sensitive identity datasets across multiple platforms creates tempting targets—or honeypots—for cyberattacks.
- AISA concerns—The Australian Information Security Association (AISA) has raised serious security concerns, noting that mandating age verification would require numerous organizations, many of which are headquartered overseas, to collect identity data. AISA warns that this could create another honeypot for hackers, raising doubts about the government's ability to guarantee the security of highly sensitive information, especially given recent large-scale Australian data breaches, such as the Qantas breach7.
- Biometric risk—Age-estimation technologies based on biometrics, including facial geometry analysis, raise essential questions about the long-term storage and security of identity data. If sensitive biometric data is compromised, the risk of identity theft is significantly higher than with data associated with simple login credentials. Mitigation strategies include performing age estimation locally on the user’s device, transmitting only a “Yes/No” age verification token to the server, or implementing a zero-retention policy that deletes all data and information once the age is verified.

Evasion and Dark Web Migration
Another significant cybersecurity concern is the risk posed by evasion tools and the migration of young users to less-regulated, less-visible spaces. These concerns include:
- VPNs and fake identities—Adolescent users are highly digitally literate and adept at finding security workarounds. A blanket ban, such as the Act, could lead to the increased use of virtual private networks (VPNs) to mask user locations or the widespread creation of false accounts using manipulated dates of birth.
- The unregulated fringe—If mainstream platforms become inaccessible due to verification requirements, vulnerable users may be pushed toward unregulated, private, or encrypted chat services, underground forums, or niche platforms that lack the content moderation and safety mechanisms mandated by the Australian eSafety Commissioner. This migration to the dark web fringe could expose children to greater risk, including exploitation and malware without any safety oversight.
Safeguarding children’s wellbeing online, while undoubtedly a worthwhile endeavor, could unintentionally expose them to identity and security threats if age-assurance mechanisms are not implemented using privacy by design standards.
The Way Forward: Implementation and Education
Australia’s SMMA obligation hinges on platforms taking reasonable steps to protect children online8. This involves not a single technological solution but a layered approach that combines various methods.
Multilayered Age Assurance
The eSafety Commissioner has indicated that relying solely on self-declaration (i.e., the user ticking a box saying they are older than 16) will fall short of the new obligation. Platforms are expected to combine several methods:
- Behavioral signals infer a user's age based on their activity, content consumption, and network structure.
- Age estimation uses technology such as facial analysis to estimate a user's age without necessarily storing biometric data permanently.
- Identity review offers pathways for users to verify their age through documentation, provided that an alternative that does not require ID is always available to protect user choice and privacy.
The Australian government has invested in an Age Assurance Technology Trial to evaluate the effectiveness and privacy compliance of various solutions9, indicating a commitment to developing technology that is privacy-preserving and robust.
Education, Not Isolation
Crucially, experts warn that a ban is not a silver bullet. Prohibition can breed secrecy, not safety. In addition to the existing guidance from the Commissioner, the way forward must include robust educational countermeasures, including:
- Digital duty of care—The overarching recommendation from many advocacy groups is not just an age ban, but also the enactment of a broader digital duty of care for platforms10. This would require organizations to design their algorithms and products to be fundamentally safer for all users, regardless of age, by prohibiting the harvesting and exploitation of the data of minors and protecting against targeted, unsolicited advertisements.
- School and parent programs—The eSafety Commissioner must roll out a comprehensive national education program, via schools and trusted channels, to teach young people about digital resilience, risk management, and the platforms covered by the new rules. This must focus on helping minors develop the necessary emotional and digital skills before age 16.
- Alternative pathways—Policymakers must actively ensure that by blocking those under 16 from general platforms, they are not simultaneously cutting them off from vital online mental health resources and support networks that many young people rely on. Educational and health services are exempt, but their accessibility and visibility must be strengthened to compensate for the loss of reach provided by mainstream feeds.
Secure by Design Architecture for Age-Assurance Systems
Cybersecurity professionals should ensure that age-assurance mechanisms are built on secure by design principles. This includes implementing strict data minimization, role-based access controls, and end-to-end encryption for any data processed during age verification. Platforms should also adopt zero-retention or short-retention policies for biometric or sensitive identity data, ensuring that only a nonidentifiable verification token is stored after the process is completed. Conducting regular privacy impact assessments and embedding privacy by design controls ensures compliance not only with the Act but with global privacy expectations and International Organization for Standardization (ISO) and International Electrotechnical Commission (IEC) ISO/IEC 27701-aligned governance practices11.
Continuous Monitoring and Threat Intelligence Integration
Given that age-assurance systems will quickly become high-value targets for attackers, organizations must integrate continuous security monitoring, including anomaly detection, behavioral analytics, and automated alerting, focused on identity-verification workflows. Platforms should consume and operationalize threat intelligence feeds, particularly those related to identity theft, synthetic IDs, biometric spoofing techniques, and dark-web credential circulation. Cybersecurity teams should run regular red team exercises against age-verification endpoints to simulate evasion attempts by minors or malicious actors, ensuring controls remain effective against VPN misuse, falsified metadata, and emerging bypass tools.
Utilizing these methods and implementations will enhance the robustness and reliability of age verification systems, ensuring effective protection for children online.
Conclusion
Australia’s SMMA obligation is a vital piece of legislation, driven by an urgent need to protect children from serious, measurable online harms. While it marks a significant shift in accountability from parents to platforms, the road ahead is filled with technical, privacy, and social hurdles.
Social media platforms must use robust age-verification technologies to ensure the online safety of minors. The success of Australia’s landmark ban will ultimately depend not only on how effectively platforms enforce the age limit but also on the Australian government's commitment to ensuring that verification processes are cybersecure and privacy compliant. This requires a layered technological approach that not only verifies the user’s age but also protects user privacy. In addition, it relies on allocating resources to educational programs that promote genuine digital literacy, ensuring that digital safeguards protect rather than isolate the next generation of Australians and serve as a model for effective and secure age verification worldwide.
